Layers loaded from Browser are unusable

Description
When loading a layer from the browser panel, the layer is not usable, as it is never being detected as "active layer".
It seems like the layer panel does not detect whether a layer is selected or not.
tested for
- *.shp
- *.gpkg
- PostGIS
In 3.2.1 / 2.18.23 this is not an issue.
Loading a *.shp file via drag&drop also does not show this issue.
